Terms and Conditions
Your booking is with Manoir Theron. Please read this carefully.
When you book a holiday with Manoir Theron it is forming a contract
and therefore both you and Manoir Theron have responsibilities and
commitments that are binding.
1. All terms are per week. Check-in time is after 4pm (subject to
unavoidable delays) on the day of arrival and check-out time is before
10am on day of departure. You are obliged to leave everything in
a clean and tidy condition and are responsible for any damage or
loss sustained during your stay. An appropriate amount will be retained
from your security deposit if necessary to cover any damages, losses
or additional cleaning.
2. The prices do not include insurance. It is your responsibility
to arrange any necessary personal travel insurance
3.We reserve the right to correct errors in advertised prices. We
will advise you of any error at the time of booking. We also reserve
the right to correct errors in confirmed prices. In this case, we
will contact you as soon as we become aware of the error. If the
correct price is higher and you do not wish to pay this, you will
be entitled to cancel and receive a full refund of all monies you
have paid to us providing you notify us within 14 days of our advising
you of the error. We promise we will not seek to correct any error
in a confirmed price within 10 weeks of the start of your holiday
or more than 7 days after you make your booking.
4. Making a booking. When you book you are accepting on behalf of
your party the terms of these booking conditions. A binding contract
comes into existence once we have received your deposit and we have
issued a booking acceptance. In all cases these Booking Conditions
form the basis of your contract.
Cancellation and refunds: You have the right to cancel within seven days of
paying your inital deposit and will receive a full refund of all monies paid
providing the holiday has not already started. After this 7 day period this
contract is binding . See clause 8 of terms and conditions.
You must check your booking acceptance as well as all other documents we send
you carefully as soon as you receive them. If any information appearing on
any document appears to be inaccurate in any way, you must let us know straight
away. We regret we cannot accept any liability if we are not notified of any
inaccuracy in any document within 10 days of our sending it out .
All information provided when booking must be complete and accurate. If you
fail to provide such information we have the right to refuse you entry to the
house.
5. The total number in your party must not exceed 12. Babies under
1 are not normally counted as a member of your party.
6. Payment. When you book you must pay the 30% Deposit requested.
Your balance is due and payable by 10 weeks before your holiday start
date together with the 500euro security deposit. For bookings made
within 10-weeks of your holiday start date you pay the full amount
when you make your booking.
7. Changes by you. You may not transfer your booking to another
party/group or substitute an individual/s without prior agreement
with us.
8. Cancellation by you. Inform us immediately if you have to cancel
and on the same day send us written confirmation. Your cancellation
is effective from the date we receive your written confirmation from
you. Subject to the provisions of clause 4, any monies paid at time
of cancellation will be retained by Manoir Theron unless the holiday
is re-let. In this case the sum will be refunded less a 100euros
administration fee. We will accept cancellation or other alterations
by e-mail provided you receive confirmation from us of cancellation
or amendment.
9. Minors. We cannot accept bookings from anyone under 18 years
of age or for groups of young people or single sex parties without
prior agreement. Should you arrive without having provided all the
necessary information, not as described on the booking form or the
group is single sex/young persons as described above (unless agreed
with Le Manoir prior to your arrival) we have the right to refuse
to hand over the accommodation to you.
10. Linen and towels. Bed linen is provided (this may be duvets
or blankets and sheets). Towels are provided as described.
11. Availability. Your booking is accepted on the understanding
that Manoir Theron will be available for your use on the agreed date.
Very occasionally, in circumstances of “force majeure”(as
defined in clause 17) we may have to cancel your booking. If we do
so we will tell you as soon as possible, and give a full refund.
We regret we cannot pay any compensation or meet any expenses or
costs you may incur as a result of any such cancellation or change.
12. Facilities and Activities. We reserve the right to alter or
withdraw amenities or facilities or any activities without prior
notice, where reasonably necessary due to repairs, maintenance, weather
conditions and circumstances beyond our control.
13. Unreasonable behaviour. We have the right to refuse to hand
over accommodation to anyone who, in our reasonable opinion,is not
suitable to take charge of it. In such cases, all hire charges paid
will be refunded in full, as quickly as reasonably practicable, the
contract will be terminated and we will have no further liability.
We have the right to terminate a holiday after the keys have been handed over,
if the unreasonable behaviour of anyone in the holiday party is likely to cause
danger or significant annoyance to others or damage to property. In these circumstances
no refund will be given. Note that unreasonable behaviour specifically includes
smoking by any member of your party inside Manoir Theron.
14. Damage to the property. The hirer is liable to us for any damage
caused in the property during the period of hire. We have the right
to enter any accommodation (without prior notice if this is not practical
or possible) if special circumstances or emergencies arise (for example
if repairs need to be carried out).
15. Disabled, infirm and restricted mobility guests. Unfortunately
Manoir Theron is unsuitable for visitors with mobility difficulties,
we have made every effort to ensure that our description makes this
clear. If your party contains individuals who usually require special
care due to a disability, you are entirely responsible for ensuring
that all members of the group are adequately cared for at all times
by suitable persons.
16. Security Deposits. A 500euro security deposit is payable for
all holidays. This will be collected at the time the balance is paid.
This will be returned to you within 10 days of departure less any
amount retained to cover damages, losses and additional cleaning
costs.
17. Force majeure. We cannot accept responsibility or pay any compensation
where the performance or prompt performance of our contract with
you is prevented or affected by reason of circumstances which amount
to “force majeure”.
Circumstances amounting to “force majeure”include any event which
we could not, even with all due care, foresee or avoid. Such circumstances
include the destruction or damage of the property (which cannot reasonably
be remedied to a satisfactory standard before the start of your holiday) through
fire, flood, explosion, storm or other weather damage, break-in, criminal damage
or any similar event beyond our or the owner’s control. Such circumstances
also include riots or civil strife, industrial action, natural or nuclear disaster,
fire, adverse weather conditions, war or threat of war, actual or threatened
terrorist activity and all similar situations beyond our or the owner’s
control. However with ref to clause 11, the fees you have paid for your holiday
will be refunded in full.
18. Your pet. Manoir Theron is pet free. Please refer to clause
4.
19. Your vehicles. Your vehicles and their accessories and contents
are left entirely at your risk. We will not be responsible for any
loss or damage from or to any vehicle from any cause whatsoever other
than, the negligence of ourselves or our employees or agents.
20. Liability. Except where otherwise specified in these Booking
Conditions we cannot accept liability for any damage, expense, injury,
death or loss of any nature whatsoever suffered by any person(s)
from any cause whatsoever other than, the proven negligence of ourselves
or our employees or agents
This does not attempt to exclude negligence or breach of statutory duty.
21. Comments or concerns. You must notify any shortcomings with
your property ourselves so that remedial action, if appropriate,
can be taken. For all complaints and claims which do not involve
personal injury, illness or death, we regret that it may affect our
ability to investigate your complaint and may impact on the way that
your complaint is handled if you fail to notify ourselves of any
complaint or claim during your holiday and write to us with full
details within 28 days of the end of your holiday.
22. Data Protection Policy. In order to process your booking and
to ensure that your holiday arrangements run smoothly and meet your
requirements we need to use the information you provide such as name,
address, and ages as asked on the booking form. We take full responsibility
for ensuring that proper security measures are in place to protect
your information. The information may also be provided to security
or credit checking companies, public authorities such as customs/immigration
if required by them, or as required by law.
(If we cannot pass this information to the relevant suppliers, we cannot provide
your booking. In making this booking, you consent to this information being
passed on to the relevant persons.)
You are entitled to a copy of your information held by us. If you would like
to see this please contact us.
We will hold your information, where collected by us, and may use it to inform
you of offers in the future. If you do not wish to receive such approaches
in the future, please opt out on the booking form |
